The Demise of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the introduction of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been stabilised. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of contrasting events captured the bleak nature of the recent timeframe. By day, political struggles are conducted: optimistic declarations are released from different nations. Significant resources is expended on restraining specific proposals. By night, Russian leadership clearly shows the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was revealed. Ukraine is able to track missile launches from across the border, a ability afforded by timely intelligence. From vantage locations, military aircraft that had been deployed to counter approaching aerial threats roared overhead – sophisticated military planes delivered to Ukraine by NATO members.

Shortly after, Kyiv's air-defence systems thundered: defensive missiles deployed against a hostile projectile. This was a modern interception technology at work, most likely supplied through Western nations. Every launch jolts you unexpectedly, rattling buildings. The instant of fear quickly transforms into sober acceptance: possibly the hostile projectile won't cause damage this time, sparing the city from devastation and additional electricity failures.

Persistent Threats

Following this, a heavy machine gun engaged a drone in the vicinity, part of a defensive team – most likely allied-provided weaponry. Sadly, the shots failed to hit the enemy aircraft – it maintained course toward its objective.

Intermittently, this continued until dawn. Kyiv awoke to the morning news: seven people killed, damage and utility failures in many homes as a result of the night's assault. As typically, everyone still continued their routines – living the war. But those full day illustrated Ukraine's vital need on external assistance – a reliance that European nations are demonstrably unable to fill in the short term.

Failed Diplomacy

The detailed framework from US administration provoked deep reactions, debate and deep concern – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and bilateral conferences.

Every new initiative from US leadership follows the consistent cycle: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This cycle will, undoubtedly, endure.

Political Considerations

It is easy to blame certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the whole story. Washington works based on a assumption understood by seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The White House assumes that it is unrealistic to pressure the Kremlin to abandon the land that it presently holds in Ukraine's occupied territories.

The issue is that while recognising this factual reality, Washington does little to discourage Russia, through words or deeds, from assuming that the status quo will not evolve additionally in its benefit in the near future.

Opposing Positions

Therefore, Russian leadership is certain that duration works to their advantage – that Ukraine and its supporters are coming close to fatigue. Their motivation to sign a deal that does not give them the largest achievable advantage is close to zero. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's leadership remains highly assured in the conclusion.

On the contrary, Kyiv believes that Ukraine can still persist, slowly losing people and territory but avoiding a entire defensive failure until circumstances change in its favour.

Current Realities

Objectively, there are no real preconditions for a truce. Now, individual motivations are becoming relevant: political desires to negotiate peace and secure international recognition, and Ukrainian leadership's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unworkable, so that their focus does not move to domestic problems. And although their mission will now be much harder after recent developments, it remains very improbable that this will modify their basic position.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a mere seven days to eliminate the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, recent disclosures, all achieved their purpose.

While new proposals based on previous concepts are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to fend off political attacks from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the coming months, primarily depend on continued Western support.
